These terms govern your use of Sporticly. By using the app or website, you agree to be bound by them. Written as plainly as possible.

Plain English summary

Use Sporticly fairly and legally. Don't copy or reverse-engineer the app. Premium subscriptions are managed entirely through Apple. Your data lives on your device — if you lose your phone or delete the app, the data is gone. Sporticly is a fitness tool, not a substitute for professional medical advice. The operator is an individual, not a company.

Acceptance of Terms

By downloading, installing, or using the Sporticly iOS application ("App") or accessing sporticly.com ("Website"), you agree to be bound by these Terms and Conditions ("Terms") and the Privacy Policy.

If you do not agree with any part of these Terms, do not use Sporticly.

Eligibility

Sporticly is rated suitable for users aged 9 and older. Depending on your country of residence, additional rules apply to minors:

  • European Union: Under GDPR Article 8, the digital age of consent ranges from 13 to 16 depending on the member state. Users under that age must use Sporticly only with the consent and supervision of a parent or legal guardian. By granting iOS permissions on behalf of a minor, the parent or guardian provides this consent and accepts these Terms on the minor's behalf.
  • United States: Children under 13 must have parental consent in line with COPPA.
  • Other jurisdictions: Use of Sporticly by minors must comply with the laws of the user's country of residence.

By using Sporticly, you confirm that you meet these requirements and that your use complies with the laws of your jurisdiction.

The App & Website

Sporticly is an iOS fitness application operated by Stefan Canz, an individual based in Switzerland (the "Operator"). The App and the accompanying Website at sporticly.com are the sole platforms through which Sporticly is offered. Full contact details for the Operator are provided in the Impressum.

Sporticly does not require an account. No personal data is transmitted to any server operated by the Operator. All app data is stored exclusively on your device. The Website is informational and does not collect personal data beyond what is outlined in the Privacy Policy.

Sporticly includes the following features:

  • Immersive workout tracking — real-time tracking of your workouts with detailed in-session metrics
  • Full workouts — a library of complete, guided workout programs
  • Detailed streaks — track your consistency and training momentum over time
  • Statistics — in-depth progress data and performance history
  • Gamification — XP system, highscores, and rewards to keep you motivated
  • Challenges — goal-based fitness challenges to push your limits
  • Shop — spend earned XP currency on in-app rewards and customisation

Permitted Use

The Operator grants you a limited, personal, non-exclusive, non-transferable, revocable licence to use the App for your own personal, non-commercial fitness purposes. This licence does not include the right to:

  • Reproduce, modify, or create derivative works based on the App or its content
  • Sell, sublicense, or commercially exploit any part of the App or its features
  • Reverse-engineer, decompile, or disassemble any part of the App, except to the extent that applicable mandatory law expressly permits such activity
  • Use the App in any way that violates applicable law or these Terms

Prohibited Conduct

When using Sporticly, you must not:

  • Violate any applicable local, national, or international law or regulation
  • Attempt to circumvent, disable, or tamper with any security or encryption feature of the App
  • Use automated tools, bots, or scripts to interact with the App or Website
  • Misrepresent your identity or affiliation in any communication with the Operator
  • Use any content or data from the App for commercial purposes without prior written consent
Violations

Violations of these Terms may result in your access being revoked and, where applicable, referral to the relevant legal authorities.

Premium & Payments

Sporticly is available in two tiers: a free tier and Sporticly Premium, an optional paid subscription that unlocks the following additional features:

  • Unlimited workouts — unrestricted access to all workout plans and programs
  • Advanced stats — detailed progress analytics and performance charts
  • Custom challenges — the ability to create and track personalised fitness challenges

XP currency & Shop: Sporticly includes an in-app Shop where you can spend XP — a virtual currency earned exclusively through completing workouts, challenges, and in-app activity. XP cannot be purchased with real money, has no monetary value, and is non-transferable. It is used solely for in-app customisation and rewards.

Apple is the merchant of record. All Premium subscriptions are processed exclusively through Apple's App Store (StoreKit) and are governed by your agreement with Apple. The Operator does not handle, store, or have access to any payment information.

  • Billing — subscription fees are charged at the start of each billing period through your Apple ID
  • Auto-renewal — subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period via your Apple ID settings
  • Cancellation — you retain Premium access until the end of the current paid period after cancellation
  • Refunds — refund requests are handled by Apple under Apple's policies. The Operator cannot directly issue refunds for App Store transactions. Mandatory consumer rights under EU, UK, or local law (such as the EU 14-day right of withdrawal for digital services, where applicable) remain unaffected and can be exercised through Apple's standard support channels.
  • Price changes — reasonable advance notice will be provided. Continued subscription after the effective date constitutes acceptance of the new price.

Local Data & Backups

Because Sporticly stores all your data exclusively on your device and never transmits it to any server, you should be aware of the following consequences:

  • If you delete the App, your workout history, stats, streaks, XP, and settings are permanently and irrecoverably lost. The Operator cannot restore any data because the Operator never receives or holds it.
  • If your device is lost, stolen, or factory-reset, your Sporticly data goes with it.
  • Backups (e.g. via iCloud or iTunes) are managed entirely by you and Apple. Whether your Sporticly data is included in a backup depends on your iOS settings.

This is the trade-off for an offline, account-free, server-less app. You retain full privacy and control; in exchange, data preservation is your responsibility.

Intellectual Property

All content within Sporticly — including the App design, interface, source code, graphics, logos, workout content, and data visualisations — is owned by the Operator (or its licensors) and protected by applicable intellectual property laws.

You may not copy, reproduce, or distribute any part of the App or Website without prior written permission. Any feedback, suggestions, or ideas you voluntarily provide to the Operator may be used in the App without obligation to compensate you, while you retain ownership of any underlying ideas of your own.

Health Disclaimer

Sporticly is a personal fitness tool. It is not a medical device, not a substitute for professional medical advice, and not a substitute for in-person coaching by a qualified trainer. All workout plans, recommendations, and progress metrics provided by the App are for informational and motivational purposes only.

The App's recommendations are generated automatically based on the height and self-rated endurance you enter. They are not personalised medical advice and do not account for medical conditions, injuries, medications, pregnancy, or other individual health factors.

Always consult a qualified healthcare provider before beginning a new exercise programme, particularly if you have pre-existing medical conditions, injuries, or other health concerns. Stop exercising and seek medical attention immediately if you experience pain, dizziness, chest discomfort, shortness of breath, or any other unusual symptoms.

By using Sporticly, you acknowledge that you do so at your own risk and that the Operator bears no responsibility for any injury, illness, or other health outcome arising from your use of the App, except where liability cannot be excluded under applicable mandatory law.

Disclaimers

Sporticly is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, the Operator makes no warranties, express or implied, including that:

  • The App will be uninterrupted, error-free, or free of bugs
  • Fitness metrics and progress data will be accurate or complete at all times
  • The App will meet your specific personal requirements or expectations
  • Any defects in the App will be corrected within a specific timeframe

Nothing in these Terms excludes or limits any liability or right that cannot be excluded or limited under the mandatory consumer protection laws of Switzerland, the European Union, the United Kingdom, or your country of residence.

Limitation of Liability

To the fullest extent permitted by applicable law, the Operator shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the App or Website, including but not limited to:

  • Loss of data stored on your device
  • Inaccuracies in fitness or progress data
  • Any injury or health outcome arising from following workout plans or programs
  • Interruption or discontinuation of the App or any of its features

Liability for damages caused by intent or gross negligence, for personal injury caused by the Operator's negligence, and any other liability that cannot be excluded under applicable mandatory law (including the Swiss Code of Obligations and the EU Product Liability Directive) remains unaffected.

Force Majeure

The Operator is not liable for any failure or delay in the operation of the App or Website caused by events beyond reasonable control, including natural disasters, internet or telecommunications outages, App Store outages, regulatory action, war, civil unrest, or pandemics.

Apple-Specific Terms

The following terms apply because Sporticly is distributed through Apple's App Store. They are required by Apple's developer agreement.

  • Parties to this agreement. These Terms are concluded between you and the Operator only — not with Apple. Apple is not responsible for the App or its content.
  • Scope of licence. The licence granted to you is limited to use of the App on any Apple-branded device that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms.
  • Maintenance and support. The Operator is solely responsible for any maintenance and support of the App. Apple has no obligation to provide any maintenance or support services.
  • Warranties. The Operator is solely responsible for any warranties, express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the App's purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App.
  • Product claims. The Operator (not Apple) is responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to conform to applicable legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
  • Intellectual property claims. If a third party claims that the App infringes their intellectual property rights, the Operator (not Apple) is solely responsible for the investigation, defence, settlement, and discharge of any such claim.
  • Third-party beneficiary. You acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

Termination

You may stop using Sporticly at any time by deleting the App from your device. All locally stored data will be permanently removed upon deletion.

The Operator may discontinue the App or any of its features. Where the discontinuation materially affects active Premium subscribers, the Operator will, where reasonably possible, provide at least 30 days' advance notice through the App, the Website, or by other reasonable means. In the event of discontinuation, any unused portion of a prepaid Premium subscription period may be eligible for a refund through Apple under Apple's standard policies.

Provisions of these Terms that by their nature should survive termination — including intellectual property rights, disclaimers, and limitation of liability — will continue to apply.

Governing Law & Jurisdiction

These Terms are governed by the substantive laws of Switzerland, excluding its conflict-of-laws rules and excluding the United Nations Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction for disputes between the Operator and a user who is not a consumer is the competent court at the Operator's place of residence in Switzerland.

Consumers. If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction with mandatory consumer protection law, the choice of Swiss law does not deprive you of the protection of mandatory provisions of the law of your country of residence (Rome I Regulation Art. 6, or equivalent rules). Consumers may bring proceedings in the courts of their country of residence, where mandatory law so permits.

The European Commission provides a platform for online dispute resolution at ec.europa.eu/consumers/odr. The Operator is not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

Changes to These Terms

These Terms may be updated from time to time. For material changes, the Operator will provide at least 14 days' advance notice via the App or the Website before the changes take effect. If you do not agree to the updated Terms, stop using Sporticly before the effective date. Continued use after that date constitutes acceptance of the revised Terms. Non-material changes (such as typo corrections or formatting updates) take effect immediately upon posting.
