Acceptance of Terms

By downloading, installing, or using the Sporticly application ("App") or accessing sporticly.app ("Site"), you agree to be bound by these Terms and Conditions ("Terms") and our Privacy Policy.

If you do not agree with any part of these Terms, you must not use Sporticly. Continued use after any update constitutes acceptance of the revised Terms.

Eligibility

Sporticly is available to users aged 13 and older. If you are under 18, you confirm that a parent or legal guardian has read and agreed to these Terms on your behalf.

By using Sporticly, you confirm that all information you provide is accurate, current, and complete.

Your Account

To access certain features you must create an account. You are responsible for:

• Keeping your credentials confidential
• All activity that occurs under your account
• Notifying us immediately at support@sporticly.app if you suspect unauthorised access
• Providing truthful and up-to-date account information

We may suspend or terminate accounts we reasonably believe have been compromised or used fraudulently.

Permitted Use

Subject to these Terms, Sporticly grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the App for your own personal, non-commercial purposes. This licence does not include the right to:

• Modify, reproduce, or create derivative works based on the App or its content
• Sell, resell, or commercially exploit any part of the App or its data
• Access the App using automated means, bots, or scrapers
• Reverse-engineer, decompile, or disassemble any part of the App

Prohibited Conduct

When using Sporticly, you must not:

• Violate any applicable local, national, or international law or regulation
• Impersonate any person or misrepresent your affiliation with any entity
• Interfere with or disrupt Sporticly's servers, networks, or infrastructure
• Attempt to gain unauthorised access to any part of the App or other user accounts
• Circumvent or disable security or access-control features
• Use workout data obtained through Sporticly for commercial purposes without written consent

Subscriptions & Payments

Sporticly offers a free tier and an optional paid subscription ("Sporticly Pro"). All subscriptions are managed through Apple's App Store and subject to Apple's payment terms.

• Billing — Fees are charged at the start of each billing period and are non-refundable except as required by law
• Auto-renewal — Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period via your Apple ID settings
• Cancellation — You retain Pro access until the end of the paid period following cancellation
• Price changes — We will provide reasonable advance notice; continued subscription constitutes acceptance
• Refunds — Refund requests must be submitted through Apple; we do not process refunds directly

Intellectual Property

All content within Sporticly — including the App design, graphics, interface, code, logos, text, data visualisations, and workout content — is owned by Sporticly or its licensors and protected by applicable intellectual property laws.

Any feedback, suggestions, or ideas you provide may be used by Sporticly without obligation to compensate you.

Health Disclaimer

Sporticly is a fitness tracking tool, not a medical device. Information and data provided through the App — including heart rate, calorie estimates, VO₂ max, and recovery scores — are for informational purposes only and are not a substitute for professional medical advice, diagnosis, or treatment.

Always consult a qualified healthcare provider before starting a new exercise programme, especially if you have any existing medical conditions. Stop exercising and seek medical help if you experience pain, dizziness, shortness of breath, or any unusual symptoms.

Disclaimers

Sporticly is provided on an "as is" and "as available" basis without warranties of any kind. We do not warrant that:

• The App will be uninterrupted, error-free, or free of harmful components
• Fitness data or metrics will be accurate or complete at all times
• The App will meet your specific requirements or expectations

To the fullest extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the fullest extent permitted by applicable law, Sporticly and its directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of or inability to use the App
• Inaccuracies in fitness data provided through the App
• Unauthorised access to your account or data
• Any third-party conduct accessible through the App

Our total aggregate liability shall not exceed the greater of (a) amounts you paid us in the 12 months preceding the claim, or (b) £100 GBP. Some jurisdictions do not allow these limitations; they may not apply to you.

Termination

You may delete your account at any time within the App's settings or by contacting support@sporticly.app.

We may suspend or terminate your access for any reason — including breach of these Terms — with or without notice. Provisions intended to survive termination (intellectual property, disclaimers, liability) will do so.

Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are an EU consumer, mandatory consumer protection laws in your country of residence may also apply.

Changes to These Terms

We may modify these Terms at any time. For material changes, we will provide at least 14 days' notice via the App or email. If you do not agree to updated Terms, stop using Sporticly before the effective date. Continued use constitutes acceptance.
